By engaging Digitalx ("the Agency") for high-tech services including React/Next.js development and SEO, you ("the Client") agree to these terms.
Services & Scope
Digitalx provides elite digital services including:
- Web Development: Custom coded solutions using Next.js, Tailwind CSS, and Supabase.
- Digital Marketing: High-ROI campaigns on Google and Social platforms.
- Business Setup: CIPC and SARS compliance services.
Fees & Payment Terms
Standard Payment Schedule:
- Projects under R5,000: 100% upfront.
- Projects over R5,000: 50% deposit, 50% on completion (Pre-deployment).
- Retainers: Monthly in advance (1st of month).
Late payments accrue interest at 5% per month. Code ownership is withheld until full payment.
Intellectual Property (IP)
Pre-existing IP: Digitalx retains ownership of our proprietary code libraries and "The Arsenal" tools.
Deliverables: Upon full payment, you own the final static build and content.
Limitation of Liability
Digitalx is not liable for third-party platform changes (e.g., Google Algorithm updates) or downtime caused by hosting providers (Vercel/AWS).
Governing Law
These terms are governed by the laws of the Republic of South Africa. Jurisdiction: Cape Town Magistrates Court.
